So we all know Arkansas passed this genius piece of legislation on the 4th:
BE IT ENACTED BY THE PEOPLE OF THE STATE OF ARKANSAS:This is saddening and disgusting on SOOO many levels. First, there are a purported 3 times the number of children in the foster care system in Arkansas than there are foster homes. In addition, there is an estimated over 400 children who will be removed from their current foster homes and placed in group facilities because of this measure.
Section 1: Adoption and foster care of minors.
(a) A minor may not be adopted or placed in a foster home if the individual seeking to adopt or to serve as a foster parent is cohabiting with a sexual partner outside of a marriage which is valid under the constitution and laws of this state.
From my reading there is nothing speaking to retroactivity (shout out to Prop 8 there!), so I have no idea what this will mean to FINALIZED adoptions where an adoptive parent is homosexual. The ACLU has yet to publicize their position on the new law. However, since they originally fought this action in Arkansas, I am sure they will try to get this overturned. >DONATE<
But other than the obvious fact that, anyone who wants to open their home to a child who needs one should deserve our respect and support, is what the fuck has happened to our right to privacy?
How the hell does the state government of Arkansas enforce this? You obviously have to have a home-study to foster in Arkansas, so that would pick up whether there was something LIVING in the house. But how do they know if it is a friend? Roommate? Are their CONTINUING visitation? Maybe we should be looking for the signs of CHILD ABUSE rather than the sexual preference of people. Do these religious right-wing nuts think that if they "law" the "gay" out of the world that they will be forced to actually STAY IN THE CLOSET THEMSELVES? Doubtful.
With Prop 8 and this backwoods douche-bagery, this election is very bitter-sweet for me. We can only hope that the incredible equality that was exhibited in the presidential election will flow to the rest of the country and that new appointees will be cognizent of the need to err on the side of equality. I'm going to take a xanax now....
